High Court in Soroti has today 20th January 2023, upheld the election victory of Hon. Joseph Andrew Koluo as the elected member of Parliament for Toroma county.
It should be noted that during the 2021 General Election, Andrew Joseph Osiya who lost the race to his counterpart Joseph Kuluo with a total number of 8,013 votes against 9,179 votes by the victor challenged the outcome on grounds that the election was not conducted under the principles and provisions of the electoral laws and allegedly affected the results substantially.
His Lordship Musa Sekana, in his ruling at Soroti High Court, blamed the petitioner for failing to discharge the burden of proof in the court case and further found the affidavits filled to be in contravention of the law.
He further noted that the petitioner was responsible for the alteration of the results explaining that it was a criminal offense meant to be proved till its logical conclusions pointing out that the petitioner failed to prove to the court the allegations citing them to be a mere creation of the petitioner.
The judge later ruled that no order of costs was awarded to the petitioner.
